1. Introduction & Data Controller

Ohana Rentals is operated by Moritz Meyer, a private individual ("we", "us", "our"). We are committed to protecting your personal data in accordance with Regulation (EU) 2016/679 (GDPR), applicable Portuguese law (Lei n.º 58/2019), and the German Telemedia Act (TMG).

Payment card details — collected and stored exclusively by Stripe, Inc. We never see or store your full card number, CVC, or expiry date. We receive only a tokenised reference (payment method ID) and a Stripe Customer ID.

Duration and total amount charged
PIN codes issued (hashed/tokenised)
Damage reports and notes (if applicable)

3. Purposes & Legal Bases of Processing

Contract performance (GDPR Art. 6(1)(b)): Processing your name, email, payment token, and rental records is necessary to execute the rental contract — issue your PIN, charge the correct amount on return, and send your receipt.

Legitimate interests (GDPR Art. 6(1)(f)): Retaining transaction records for dispute resolution, fraud prevention, and internal operational management.

Legal obligation (GDPR Art. 6(1)(c)): Retaining accounting records as required by Portuguese tax law (Decreto-Lei n.º 158/2009) and German commercial law (HGB §238 ff.).

4. Third-Party Processors

We share data only with processors necessary to operate the service, each bound by GDPR-compliant Data Processing Agreements:

Stripe, Inc. (payment processing) — 510 Townsend St, San Francisco, CA 94103, USA. EU Standard Contractual Clauses apply. Privacy policy: stripe.com/privacy
Airtable / Formagrid Inc. (database) — 799 Market St, San Francisco, CA 94103, USA. GDPR DPA available. Data stored on AWS EU servers where configured.
Hostinger International Ltd. (web hosting & automation server) — 61 Lordou Vironos str., 6023 Larnaca, Cyprus. EU-based hosting infrastructure used.

We do not sell personal data to any third party. We do not use your data for advertising or profiling.

5. Data Retention Periods

Rental & payment records: Retained for 10 years from the end of the fiscal year in which the transaction occurred, as required by Portuguese tax law (Art. 52 CIRS / Decreto-Lei n.º 158/2009) and German tax law (§ 147 AO).

Customer profile data (name, email, phone, Stripe customer reference): Retained for 5 years after your last rental, then deleted.

Damage reports & dispute records: Retained for 3 years from the date of the incident (Portuguese statute of limitations for civil claims — Art. 498 CC).

SessionStorage data: Deleted automatically when you close your browser tab — not stored on our servers.

6. International Data Transfers

Some processors (Stripe, Airtable) are based in the United States. All transfers take place under EU Standard Contractual Clauses (SCCs) as approved by the European Commission under GDPR Art. 46(2)(c), providing an adequate level of data protection.

7. Your Rights Under GDPR

You have the right to:

Access (Art. 15): Request a copy of all personal data we hold about you.
Rectification (Art. 16): Request correction of inaccurate or incomplete data.
Erasure (Art. 17): Request deletion of your data ("right to be forgotten"), subject to legal retention obligations.
Restriction (Art. 18): Request that we limit processing of your data in certain circumstances.
Data Portability (Art. 20): Receive your data in a structured, machine-readable format.
Objection (Art. 21): Object to processing based on legitimate interests.
Withdraw Consent: Where processing is based on consent, withdraw it at any time without affecting the lawfulness of prior processing.

To exercise any right, contact: boards.ohana@gmail.com. We will respond within 30 days. In complex cases this may be extended by a further 60 days; you will be notified within the initial 30-day period. We may verify your identity before fulfilling a request.

9. Cookies & Browser Storage

We do not use cookies, tracking pixels, or analytics scripts of any kind. We use browser sessionStorage exclusively to maintain your active rental session (PIN, rental ID, item name) while your tab is open. This data is stored only on your device, is never transmitted to our servers for this purpose, and is automatically and permanently deleted when you close the tab. It is not a cookie and does not require consent under the ePrivacy Directive.

Stripe.js (loaded from js.stripe.com) may set its own cookies strictly necessary for payment security and fraud prevention. These are subject to Stripe's privacy policy.

10. Security

We implement appropriate technical and organisational measures including HTTPS encryption for all data in transit, access-restricted databases, and tokenised payment storage via Stripe's PCI-DSS-certified infrastructure. No system is completely secure; in the event of a data breach affecting your rights, we will notify you and the competent supervisory authority within 72 hours as required by GDPR Art. 33–34.

11. Changes to This Policy

We may update this Privacy Policy at any time. The date at the top indicates the latest revision. For material changes, we will take reasonable steps to inform active users. Continued use of the service after changes constitutes acceptance.

1. Service Description & Acceptance

Ohana Rentals operates a self-service smart locker rental system at Nova School of Business and Economics (Nova SBE), Carcavelos Campus. By initiating a rental — entering your details and submitting the booking form — you confirm that you have read, understood, and agree to be bound by these Terms & Conditions in their entirety. If you do not agree, do not proceed with a rental.

These terms constitute a legally binding contract between you ("Renter") and the operator, Moritz Meyer ("Ohana Rentals", "we", "us").

2. Eligibility

The rental service is available to Nova SBE students, faculty, and staff ("Nova SBE Community Members") and their guests, subject to the following conditions:

Nova SBE Community Members may be accompanied by guests, who rent under the Community Member's full responsibility.
The Community Member assumes full responsibility for any guest's conduct, safe use of items, and compliance with these Terms.
By submitting your details, you confirm your eligibility and, where applicable, your responsibility for any guest.

3. Rental Process & Smart Lock

Upon confirmed booking, a one-time PIN is issued to open the smart padlock securing the locker shelf. You acknowledge and agree that:

The PIN is active for approximately 2 minutes from issuance. You must use it immediately.
Opening the locker with the PIN constitutes the start of your rental and acceptance of the item's condition.
You must lock the shelf again immediately after taking your items.
A separate return PIN will be issued when you initiate your return through the app.
You must lock the shelf again after returning all items.
Failure to lock the shelf leaves items unsecured; you remain liable for any loss or damage until the shelf is properly secured.

4. Pricing, Billing & Payment

Hourly items: Every commenced hour is billed in full. Example: 1 hour 5 minutes of rental = 2 hours charged. There are no partial-hour refunds.

Daily items: Priced per 24-hour period. Every commenced 24-hour period is billed in full.

Card authorisation: By providing your payment card details, you authorise Ohana Rentals to charge the total rental amount to your card upon return. Your card is not charged at the time of booking.

Automatic charge: Upon initiating your return through the app, the total rental fee is calculated and charged automatically to your saved payment method via Stripe. You will receive a payment confirmation by email.

Failed payment: If the automatic charge fails, you remain liable for the outstanding amount. We reserve the right to use alternative collection methods and may charge late payment interest at the statutory rate under Portuguese law (Art. 806 CC).

Currency: All prices are in Euros (€) inclusive of applicable taxes.

5. Maximum Rental Duration & Late Returns

All items must be returned within 24 hours of the rental start time. After this period:

The accumulated rental fee continues to accrue for every commenced hour/day until return.
A late return surcharge of €10 per additional commenced 24-hour period is applied from the 25th hour.
We reserve the right to contact you directly and, if necessary, report non-return to Nova SBE administration.
Items not returned within 72 hours of the rental start will be considered lost or stolen and the full replacement value (see §7) will be charged.

6. Renter's Responsibilities & Conduct

By renting, you agree to:

Inspect items before taking them. Taking an item confirms you have received it in good, functional condition.
Return items in the same clean, complete, and undamaged condition in which you received them.
Return all included components, parts, cards, accessories, and packaging.
Not transfer, sub-let, or lend rented items to any person not included in the original rental.
Use items only for their intended purpose and in accordance with any instructions provided.
Not use items under the influence of alcohol or illegal substances.
Comply with all Nova SBE campus rules and facility regulations at all times.
Report any damage, malfunction, or loss to us immediately at boards.ohana@gmail.com or via WhatsApp.
Lock the shelf securely after every interaction (taking and returning items).

7. Damage, Loss & Replacement Costs

You are financially responsible for any damage to, or loss of, rented items during your rental period. The following cost structure applies:

Games & Accessories — Damage:

Minor damage (worn packaging, minor scratches not affecting use): €5–€10
Damaged or missing components (cards, pieces, dice, parts): €10–€30 per incident
Item rendered unusable: full replacement cost of the item

Sports Equipment — Damage:

Minor damage (small cosmetic marks not affecting function): €10
Significant damage affecting function: €20–€80 depending on item
Item rendered unusable: full replacement cost

Loss or Theft (any item): Full replacement cost of the item at current market value.

Tent — Damage/Loss:

Damage to fabric, poles, or pegs: €15–€50 per component
Total loss or destruction: €120

Damage charges will be applied to your saved payment card after prior written notification by email. You have 48 hours to dispute a damage charge before it is processed. Disputes must be submitted to boards.ohana@gmail.com with photographic evidence.

8. Cancellation & No-Refund Policy

Once a rental PIN has been issued, the rental has commenced and cannot be cancelled. No refunds are issued for unused rental time. If you return an item earlier than planned, you are only charged for the hours/days actually elapsed (rounded up).

9. Assumption of Risk & Liability

Use of rented items is entirely at your own risk. You acknowledge that:

Physical sports equipment carries inherent risks of injury. By renting such items, you confirm you are physically fit to use them and will do so responsibly.
Ohana Rentals staff are not present during your use of rented items and cannot supervise your activities.
Ohana Rentals is not liable for any injury, death, or damage to third parties arising from your use of rented items.
Ohana Rentals is not liable for loss of or damage to your personal belongings during a rental.
You agree to indemnify and hold harmless Ohana Rentals, its operator, and affiliates against any third-party claims arising from your use of rented items.

This limitation of liability applies to ordinary negligence only. It does not exclude or limit liability for gross negligence, willful misconduct, or mandatory statutory liability under Portuguese or German consumer protection law.

10. Availability & Service Suspension

Item availability is on a first-come, first-served basis and cannot be guaranteed. Ohana Rentals reserves the right to temporarily suspend, restrict, or modify the rental service at any time, including for maintenance, operational reasons, or safety concerns. Such suspension does not constitute a breach of contract and does not entitle the Renter to a refund for periods not yet commenced.

11. Consequences of Breach & Termination

Material breach of these Terms — including but not limited to unauthorized transfer of rented items, non-return, non-payment, or misconduct — may result in:

Immediate termination of the rental agreement
Charge of all outstanding fees plus applicable damage/replacement costs
Permanent suspension from Ohana Rentals services
Notification to Nova SBE administration
Civil and/or criminal proceedings where applicable

12. Changes to These Terms

Ohana Rentals reserves the right to amend these Terms & Conditions at any time. For existing obligations (active or recently completed rentals), the version in force at the time of booking applies. For new bookings made after publication of updated terms, the latest version applies. We will publish changes on this page with an updated date.

13. Governing Law & Jurisdiction

These Terms are governed by Portuguese law. Any disputes arising from or related to these Terms or a rental transaction shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal. If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force and effect.

14. Privacy

Personal data is processed in accordance with our Privacy Policy, which forms an integral part of these Terms and is available via the Privacy Policy link in the footer.

15. Acknowledgement

By completing a rental, you confirm that you have read, understood, and voluntarily agreed to these Terms & Conditions, and that you are at least 18 years of age or have the consent of a legal guardian.
